1. Scope
These Terms of Use apply to VACHAR and its related services. The provider is EITCons GmbH, Am Heidekrug 5, 40724 Hilden, Germany.
2. Purpose of VACHAR
VACHAR enables users to publish local offers, requests, activities, events and other Connects and to get in touch with each other. Where users enter into agreements with one another, those agreements are generally concluded directly between the users involved.
3. Registration
A user account is required for certain features and may be used only by persons aged 18 or over. Registration information must be accurate. Access credentials must not be shared with third parties.
4. Verification
VACHAR may make certain features subject to identity or security verification. A verification badge only confirms the intended verification status and does not guarantee all information or actions of a user.
5. User content
Users are responsible for their content. In particular, the following are not permitted:
- illegal content,
- infringement of third-party rights,
- fraudulent or misleading content,
- threats or harassment,
- discriminatory, degrading or sexually exploitative content,
- prohibited goods or services,
- malware and spam.
Zero tolerance: VACHAR does not tolerate objectionable or abusive content or users who threaten, harass, discriminate against or exploit others, or who use the platform for illegal activity.
By posting content, users grant VACHAR only the rights necessary to store, display and technically provide the service.
6. Communication and contact sharing
Communication generally takes place through VACHAR. Personal contact details are shared voluntarily only through the designated feature.
7. Moderation
In the event of violations of laws, these Terms of Use or the Community Guidelines, content may be removed, features may be restricted or accounts may be temporarily or permanently suspended.
Reports involving objectionable content or abusive behavior are reviewed within 24 hours. Where a violation is confirmed, the affected content is removed within that period and the responsible user is suspended or permanently removed from VACHAR as appropriate.
8. Reports and complaints
Content and users can be reported through the designated features. Users can also immediately hide problematic Connects from their own feed and block abusive users. Other complaints can be submitted through the contact form.
9. Abuse
The following are prohibited in particular:
- spam and automated mass requests,
- fake accounts and impersonation,
- circumventing bans,
- manipulation of reports,
- fraudulent use of the platform.
10. Paid features
For paid features, the price, scope of service and, where applicable, term are displayed before purchase. Mandatory consumer protection rights remain unaffected.
11. Availability
We strive to maintain high availability. Continuous or completely error-free availability cannot be technically guaranteed.
12. Liability
Statutory liability provisions apply. Liability for intent and gross negligence and for damages arising from injury to life, body or health is not excluded or limited.
13. Suspension and termination
Accounts may be restricted or suspended in particular in cases of serious or repeated rule violations, suspected fraud, significant risk to other users or circumvention of existing bans.
14. Changes
Changes to these terms will be communicated in an appropriate manner. Where consent is legally required, changes will only take effect after the relevant consent has been given.
15. Applicable law
German law applies, subject to mandatory consumer protection provisions of the country in which a consumer has their habitual residence.
16. Internal complaint and DSA dispute settlement
Users affected by a decision to remove or restrict content, restrict functions, or suspend an account may use the internal complaint route stated in that decision. Complaints are reviewed diligently, promptly, and not solely by automated means.
Where the Digital Services Act applies, a dispute may also be submitted to an out-of-court dispute settlement body certified under Art. 21 DSA. The European Commission publishes the current list. Further information is available under User Rights. Access to the courts remains unaffected.
17. Consumer dispute resolution
We aim to resolve disputes directly and amicably first. EITCons GmbH is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
The former EU Online Dispute Resolution platform was discontinued on 20 July 2025 and is therefore no longer linked. Access to judicial remedies remains unaffected.
